Hotmail founder Sabeer Bhatia has slammed the Indian Judiciary for taking recent action against Tukaram Mundhe. In one of the cases, Tukaram Mundhe had suspended the licenses of eateries at the Mumbai Cricket Association for being 88% compliant.

Bhatia, who has been very proactive in opining about matters related to the Indian public, took a jibe at the Indian judiciary this time.

In his Twitter post, Bhatia opined that the judiciary has disappointed him and that compliance in food safety is either yes or no.

Now even India’s judiciary has disappointed me by pulling up Tukaram Mundhe and the Maharashtra FDA.

How did the court decide that eateries being “88% compliant” is good enough?

Food safety isn’t a percentage game. An eatery is either compliant or it isn’t. What if that remaining 12% causes sickness-or death?

Where exactly is the line? Cockroaches are acceptable, but poisonous animals aren’t?

On August 19th, the Bombay High Court penalized the FDA and directed it to pay Rs 5 lakh compensation. Tukharam led the FDA had suspended the license of a Pune sweet shop for 98% compliance with food safety parameters.

Then there was the case of Cadila Pharmaceuticals. The Bombay High Court also intervened in the Cadila Pharmaceuticals case, whose license was suspended by FDA. The High Court opined that the Maharashtra FDA’s action was like “using a sword to kill the mosquito” and told them to exercise their power judiciously.

Very recently, Tukaram Mundhe led the Maharashtra FDA in cancelling the license of Cipla Pharmaceuticals. After the High Court intervention, the FDA subsequently withdrew the cancellation order.

Sabeer didn’t stop there; in one tweet where he questioned the High Court Decision to reverse the suspension done by the Maharashtra FDA.

In another tweet, he took a direct dig at the Indian Judiciary by opining that the judiciary of the United States is concerned with protecting the rights of the weak and disadvantaged, while questioning the Indian judiciary for protecting the rights of the dishonest!
